Simple arithmetic shows us that, since the GOP holds 52 seats and 60 votes are needed to confirm a Supreme Court nominee, Senator Chuck Schumer (D-NY) has a little room to work with in regards to blocking Trump nominees.
A day after naming a hit list of eight of Mr. Trump’s cabinet picks that the Democrats promise to target in Senate confirmation hearings, Schumer is playing his designated role of the big Chihuahua on the issue of Supreme Court appointments.
He’s warning President-elect Trump to pick someone along the lines of the current Obama choice, a liberal who was unacceptable, gun-grabbing Merrick Garland. Garland is someone Schumer described as a “mainstream” choice and he might be, if that Second Amendment weren’t still part of the Bill of Rights. Otherwise they can expect to be opposed “with everything we have.”
Schumer said in a Wednesday interview, “My worry is, with the hard right running the show, that the likelihood of the nominee being mainstream is decreasing every day.” His comments came one day after stating that the Democrats would “absolutely” do their best to keep the vacancy on the Supreme Court unfilled if they don’t get someone that is liberal enough to give them a majority on the court.
Mitch McConnell responded to Schumer’s comments, saying, “There’s apparently a new standard now, which is to not confirm a Supreme Court nominee, at all, something the American people will not tolerate.”
McConnell has the option of following in the footsteps of former Democrat Senate Majority Leader Harry Reid and changing the rules to restrict the opportunities for Democrat filibusters on Supreme Court nominees, something Reid did for lower court and other nominees in 2013.
Trump hasn’t even been sworn into office yet and Chuck Schumer has already succeeded in making an intolerable nuisance of himself. Whenever possible Mr. Trump needs to just steamroll the big-mouthed Democrat, driving him to irrelevance as quickly and as permanently as possible. He’s got work to do and all Schumer wants to do is stall until 2018 and 2020.
