Judge Jeanine, Fmr AG Mukasey – Unusal FISA Case Is Public, FBI Usually Keeps Target Anonymous

Former Attorney General Michael Mukasey joins Judge Jeanine Pirro to gain insight from his experience into the events surrounding the Obama regime’s spying on the Trump campaign in the closing weeks of the election.

As Judge Jeanine walks through the events with the former Attorney General, Mukasey agrees with her that FISA court requests are almost always approved and the fact that this one was initially denied in June indicates to him that there was very little substance to it. He says, “What’s interesting is that application mentioned the name ‘Trump,’ although it’s not clear in what connection, and that application was denied.”

Judge Jeanine continues, saying, “And then the Obama administration goes back, whether it’s the FBI or NSA, we don’t know who goes back to the FISA court.” Mukasey interrupts her and clears that question up, saying it has to be the FBI because they are the ones with the necessary jurisdiction to conduct this kind of surveillance inside the United States.”

She asks if there is always a requirement of probable cause, as it’s different from a wire in a typical criminal case. Mukasey agrees that it is “probable cause of a different sort,” noting that the only probable cause needed to be demonstrated in the FISA courts is “that somebody on that wire is acting as an agent of a foreign power.”

He continues, “Now this may very well have had and likely did have nothing whatsoever to do with Mr. Trump. It’s because there were allegations about Manafort getting money from Putin’s puppet in the Ukraine and so on.” Judge Jeanine stops him there, noting that Manafort had not even become a member of the campaign at the time the initial warrant was sought.

She asks how we would, at this point, go about getting our hands on that FISA warrant. Mukasey replies, “You wouldn’t. He notes that the fact that this is out in the public sphere is extraordinarily unusual. FISA activity is generally, number one, highly confidential and number two for very good reasons, because first of all, we don’t want foreign powers or terrorist organizations to find out that we’re eavesdropping and second, we don’t want to damage people’s reputations if it turns out that there’s nothing there.

She questions him on the move by Obama and Lynch to expand the automatic distribution of sensitive intelligence information which has since resulted in it being much more difficult to track down and control leaks. He agrees that it’s not an implausible theory to question whether it was a deliberate set up and notes that it was not done in response to any significant threat.

She should have asked him the next question on that front, how do we undo it? This is what we expected from Obama, attacks on the US even beyond his time squatting in our White House.
