Judge Ruling Could Give US Citizens Defense Against Being DACA Steamrolled

A Judge ordering reinstatement of DACA could help the cause of US Citizens fighting the amnesty in that it has eliminated the false urgency that Dems and too many Republicans

A leftist District Court Judge in Northern Mexifornia may have done American citizens a favor by ruling against us in a “save DACA” case brought, part, by Janet Napolitano in “her” role as President of the University of California. So-called Judge William Alsup, appointed by Bill Clinton, ruled late Tuesday that the Trump administration must reinstate DACA due to procedural “errors” in cancelling it.

Alsup decided that adequate public notice was not given in the decision to cancel the illegal program, despite it operating in direct violation of US immigration law. Effectively, he ordered the executive branch and the President to violate the law. The fact that Trump’s predecessor was a criminal operating a rogue government had no bearing on the “precedent” he cited, claiming DACA was standard practice and as such a public comment period was required before it could be discontinued.

It’s an obvious conclusion that was in desperate search for a basis upon which to be rendered. But there may be a silver lining to this toxic, illegal cloud in that it potentially removes the false urgency that had been attached to awarding amnesty to the DACA illegals by the Democrats and some sellout Republicans. President Trump had joined in that effort.

The elimination of the March deadline, barring some sort of legal maneuvering and appeals by the invisible man at DOJ, AG Jeff Sessions, and the Supreme Court, means that we are now a minimum of months away from the end of the DACA program.

President Trump now has the time, if he cares to take advantage of it, to focus on building the border wall first and delaying action on the DACA illegals. He’s got the protective legal cover of being able to not act until the wall is constructed, should he choose to use it, and force Democrats to support border wall funding and construction first.

In his ruling, Judge Alsup, the latest libtard judge to pretend he’s President, declared, “The agency shall post reasonable public notice that it will resume receiving DACA renewal applications and prescribe a process consistent with this order.”

The Washington Times reports that Alsup acknowledged that DACA is “not approved by any law,” a politically prudent way to state that it is in violation of federal immigration law, but as a judicial activist that didn’t concern him. He said it “appeared to be supported by years of practice by both parties.”

Since it was implemented under a Democrat executive order by the crooked enemy of this nation, Hussein Obama, and opposed by Republicans, Alsup is obviously being dishonest in his contrived “reasoning” for his action. He said, “In extending programmatic deferred action to DACA enrollees, the agency acted within the scope of this long and recognized practice.” Long is  apparently the period from 2012 until 2017 and a new administration, under which it was cancelled.

Another ruling, by the more rational 5th Circuit Court of Appeals and other federal judges, recognized that the similar DAPA program likewise didn’t go through the notice and comment period, but that it was irrelevant because the program was itself illegal.

Alsup, while reinstating the renewal for those currently enrolled in the illegal program, did not decree that new signups must be accepted and stated that deportations, as prescribed in immigration law, could still continue. He also allowed the discontinuation of the backdoor amnesty of “advance parole” some DACA illegals had discovered as a means of circumventing the system.

Now the self-imposed deadline has been removed and President Trump can act in a manner consistent with securing our nation, building the border wall before any talk of amnesty with the Democrats. 

We can expect them to be quite conspicuous as they shift to another issue in which to utilize the threat of a faux government shutdown as a weapon against the American people. Maybe they’ll simply insist on a permanent DACA concession despite the favorable ruling. Whatever it is they won’t let a shutdown opportunity go to waste. When they redirect their efforts, it will be blatantly obvious to those paying attention.

    The biggest problem with extending DACA it allows illegals to continue to flood America.

  2. What, no bashing Trump today. I really wish more people would learn how he works – it will make your life a whole lot easier. And if you missed it, today he clarified that there would be no DACA without the wall.

    • You obviously are a new reader so I’ll clue you in, J., I was as pro-Trump as anyone on this planet for the entire campaign and afterwards, when he was doing what he said he would do. I’m not an obamabot or a trumpbot and if Trump is feeding me bullshit, I’ll spit it back out. Read back over the past two years if you’d like to see the proof, it’s all there on the website.

      I will call him on it when he strays, I’m Pro-MAGA and when he’s not doing what he said he was going to do he needs to have his feet held to the fire. He’s a big boy, he can take the truth, he even volunteered to take the heat he knew was coming with the betrayal. How many of those families who lost loved ones to illegals has he had on stage with him lately? Maybe there’s a reason.

      How about Jeff Sessions? You giving him a complete pass too? That’s reminiscent of what Loretta Lynch and Holder did as Obama puppets at DOJ, engaging in and covering up criminality.You might notice in my archives I was one of Sessions’ biggest supporters for the past few years as well, until he flipped as AG.

      They were hired to do a job. Don’t feed me the crap that he’s so much smarter than the rest of us and we just have to sit and watch. Bullshit – He needs to keep his promises. It’s not personal against him, if you read my archives you’ll see that. It’s about the future of this country, much bigger than one man.

    The President needs to appoint his own judges. These guys that are judges now think they have more authority than the President. At one time, they said the whole DACA ruling was illegal, which isn’t surprising, since Obama initiated it. Where are the President’s lawyers. They need to start giving him a little help for they money they are getting paid.

  5. Since 1989 that I know of, congress has engaged in faux efforts to split-up the 9th circuit court. Now would be a good time for that to happen. Like most of our government, it has become too big and ugly to be clean and effective.

    There has to be a remedy for this. Not sure if I have this right, but I heard somewhere that the Executive Branch can defund a court?

      James, I heard that too. Someone needs to tell the President that. Where are his good for nothing lawyers. The President should be able to close down anything that Obummer enacted that was illegal, which were a lot of executive orders. The President has cleaned up a lot of them but these clowns in the courts keep getting in the way. I think the President should have the last say in some of these issues, like immigration, DACA, the ban on immigrants, etc. The Dems still won’t let him name the rest of his cabinet. Then there’s the press lying about everything and not letting the public know exactly what the President has accomplished. Watching the President’s press conference today was proof of that. The liberals were having a field day saying all of their nasty remarks about the conference on Facebook. They will never admit that Trump has done a good job, even though he has so many enemies.
