Alan Dershowitz says Robert Mueller has the “ultimate card in his hand, the subpoena card,” but it doesn’t leave President Trump without options, one of which being to challenge any subpoena Mueller might direct at the President in court.
Dershowitz says, “He can go to the federal district court, the court of appeals, the United States Supreme Court. He can argue, A – that you can’t subpoena a President in a criminal case in front of a grand jury, he’d probably lose that broad issue. He can then argue that you can’t ask a President why he engaged in acts that are authorized under Article Two of the Constitution, he may well win that argument.” [[WATCH VIDEO BELOW]]
“And then he might argue,” says Dershowitz, “that you can’t ask him questions that go beyond the scope of the special counsel’s authority, namely to my business dealings before he became President of the United States, and he may win or he may lose that, it’s unclear. But I think he’d be in a better position challenging this legally than sitting down with the special counsel and answering that list of forty-some-odd questions that are so open-ended, so vague, and so general.”
Dershowitz says the list of questions show him that “Rod Rosenstein must be recused from any further participation in the obstruction of justice part of the case because he’s a central witness. They ask him the question, ‘Why did you fire Comey?’ And the obvious answer is because I got a memo from Rod Rosenstein. Why don’t you ask him why he wrote me a memo telling me that I can fire Comey?”
He says it is obvious from the range of questions that there are no limitations on the scope of the questions, and that “they want to ask questions that give him an opportunity to ramble on and perhaps give them information they don’t have or say things that are contradicted by information they do have.”
Dershowitz recommends that President Trump consider submitting answers in writing to most of the questions, thereby gaining an upper hand with the American public. Dershowitz reminds the audience that “one of the reasons they want to haul him in front of a grand jury or ask him questions is because they want to see if he’s going to lie. This is a perjury trap in some ways.”
Dershowitz says, “It’s not a proper role of a grand jury to set perjury traps for subjects of criminal prosecutions. The role of the grand jury is to obtain information they don’t already have, not to give the subject an opportunity to lie about answers that they do already have.”
The swamp is a filthy place, with some big snakes lurking about. Mueller is one of the biggest and nastiest.
