In an interview with Tucker Carlson, Harvard Law Professor Alan Dershowitz, who makes a point of declaring that he is a liberal who voted for Hillary Clinton, defends President Trump against the witch hunt that is underway by Democrats and the political establishment.
He says, “What the Democrats are trying to do to President Trump is exactly what some Republicans and extremists tried to do to Hillary Clinton.” Dershowitz may be a smart guy, but in that regard he’s delusional. Hillary Clinton is a criminal who committed espionage and got off because of criminal malfeasance by James Comey, Loretta Lynch, Hussein Obama and many more insiders, and the deep state influence.
He is absolutely correct in his view that the supporters of action against President Trump would be on the other side of the issue if it were a question about whether or not to target a Democrat under the same circumstances. That’s the politicization of the criminal justice system, which is part of the danger that he’s warning against.
Carlson asks what are the charges that President Trump’s opponents are accusing him of that a President should not be prosecuted for. Dershowitz cites their position as that President Trump committed obstructions of justice simply by acting on his constitutional authority. “He had the right to fire Comey, Comey acknowledged that. He had the right to tell Comey to stop investigating Flynn. Comey acknowledged that. So what is the obstruction of justice if he had the constitutional power to do that?”
He points out the differences between Trump and Nixon, in that Nixon likely committed real crimes where Trump has not, noting “There’s no allegations of any independent criminal conduct against President Trump. He likens it more to what President Bush did when he pardoned Caspar Weinberger at a time when Weinberger was about to go on trial and might have pointed a finger of accusation at him and nobody at that time really suggested that President Bush should be indicted for obstruction of justice or impeached.”
“This is selective injustice against a particular President who is unpopular with Democrats and it’s just not right.” He quotes Lavrenti Beria, Stalin’s secret police chief, who said, “Show me the man and I’ll find you the crime” noting that that is exactly what his liberal Democrat friends are doing to the President. They’re falling all over themselves, trying to find a statute that they can expand to force it into some sort of relevance and application and then put it back into obscurity once they’ve done their dirty deed.
Once that genie is out of the bottle the precedent is set and it’s part of the law from that point on.
