It’s hard to imagine a more horrific crime. Maria Peiner was just nineteen years old and eight months pregnant, excited about the upcoming birth of her child. She innocently agreed when the father, Eren Toben, invited her to go shopping for baby clothes.

Eren did not share Maria’s enthusiasm for their upcoming arrival, not wishing to be a father. Rather than discussing the situation with Maria and facing the consequences of his actions like a man, Eren chose a more sinister means of dealing with his problem.
He and a childhood friend, Daniel Mueller, hatched a scheme to kill Maria and their unborn child. A shopping trip for baby clothes was the ideal way to get her out of the house. While walking to what Maria thought was the store, Toben and Mueller lured her into some woods nearby, on the outskirts of Berlin.
It was there that Toben hit Maria with a piece of wood and then stabbed her with a bread knife. He followed that up by pouring gasoline over her and setting her on fire. Fingerprints discovered on the knife handle implicated Toben beyond a doubt. A passer-by discovered Maria’s body the following day, in January of last year. The baby would be celebrating its first birthday party about now.
In the conduct of the just completed trial, Judge Regina Alex addressed the horrific nature of the crime, pointing out, “She was still conscious, it could have been 10, 20, 30 seconds – she was still moving.” Nevertheless, as outraged as she was, and as gruesome as the crime, the murder of the young woman and her child was, the pair received only 14 year sentences.
She noted the disregard for life of both men. Judge Alex said of Toben, who came up with the plot: “For him the crime was a solution, he wanted a free, happy life which he had control over,” adding, “He abused Maria’s love for him to lure her into an ambush.”
As for his accomplice, Mueller, she said, “He acted for the sole purpose of taking pleasure in the destruction of another human being’s life.”
With a sentence of only fourteen years handed down for a crime that would have been a death penalty or life in prison in the US, it’s easy to understand why so many Middle Eastern criminals are anxious to get to Germany and why they have such little disregard for the rule of law once they arrive. That’s not punishment, it’s not justice.
